Terms of Service
SHOTMERCE TERMS

Shotmerce is provided and operated by KCREW. In these Terms, “Shotmerce,” “we,” “us,” and “our” refer to KCREW as the service provider. These Terms of Service (the “Terms”) form an agreement between you and KCREW and apply to the Shotmerce website, iOS and Android apps, and related services. By creating an account, accessing or using the service, or buying credits, you agree to these Terms.
1. Eligibility and accounts
- You must be able to enter a valid contract where you live. If consent from a parent or guardian is required, you must have it. If you use Shotmerce for an organization, you must have authority to bind that organization to these Terms.
- Customer accounts are protected by Google or Apple sign-in. Keep the linked sign-in method and devices secure, review activity on your account, and notify us promptly of suspected unauthorized use. You may not sell, rent, or share authentication credentials, an account, or credits.
- You must provide accurate account information and follow applicable law, these Terms, and app-store rules. Shotmerce operator WordPress accounts and approved review/test environments are subject to separate operational controls.
2. Shotmerce and AI results
- Shotmerce uses a product photo you select and explicitly agree to send to OpenAI to create an AI base image. One successful generation creates one AI base image; channel formats, sales designs, copy, and logo composites may then be rendered locally by the device or browser from that base image.
- A completed AI base image can be recovered from Shotmerce private storage for up to 24 hours after generation and may be removed sooner by expiry cleanup or account deletion. Save any needed result to your device during that period. Locally rendered design files may disappear when you leave the screen or device cache is cleared.
- Generative AI can misstate a product’s shape, color, text, label, quantity, or fine details. Before publishing, you must review the result, sales copy, pricing and performance claims, third-party rights, and each channel’s image and advertising rules. Shotmerce does not guarantee uniqueness, exclusivity, non-infringement, marketplace approval, or sales performance.
3. In-app-purchase credits and refunds
- The iOS and Android apps offer one-time consumable packs of 10, 30, or 100 credits through the Apple App Store or Google Play. The applicable store displays and processes local pricing and taxes. Shotmerce credits are not an auto-renewing subscription.
- One server-priced credit is used for each successfully created AI base image. One credit is reserved while processing and released if a service or AI-provider error prevents completion. When the base image is successfully created and stored, the one-credit use is final; channel-file rendering, logo composites, ZIP creation, recovery, and repeat downloads use no additional credits.
- Purchased credits do not expire while the account remains open, but they cannot be transferred to another account, sold, or redeemed for cash. Promotional, review, or test credits may have separate conditions or limits and do not convert into paid credits.
- Withdrawal, refund, and payment-reversal rights for a store purchase follow applicable law and the process of the store where you bought it. Use Apple’s refund guidance or the Google Play refund policy, and contact admin@kcrew.co.kr for a balance-posting error. When Shotmerce confirms a refund or reversal event, the credits granted for that purchase are removed. If they were already used, the balance may become negative and block further generation until a verified purchase or adjustment clears the debt.
- A subjective preference, an unexpected AI depiction, or failure to download during the 24-hour recovery period does not automatically return a credit for a successful generation. This does not limit rights under applicable consumer law or a remedy Shotmerce provides for a verified service error.
4. User content and intellectual property
- You must have all ownership, licenses, publicity/privacy permissions, and other rights needed for product photos, logos, copy, scene descriptions, and other material you provide (“User Content”). Do not upload third-party material without permission.
- You retain your rights in User Content. You grant Shotmerce a non-exclusive, worldwide, royalty-free license to host, copy, transform, transmit, and process User Content through service providers only as needed to operate, secure, and support the service and meet legal obligations. This license is subject to the deletion and retention rules.
- As between you and Shotmerce, to the extent applicable law allows, Shotmerce does not claim ownership of the AI result, and you may use it for lawful personal or commercial purposes. Whether an AI result qualifies for copyright or other protection, avoids third-party rights, or differs from another user’s result depends on applicable law and the specific facts.
- Shotmerce and its licensors retain rights in the app, website, software, brand, designs, and non-user content. These Terms transfer no rights beyond the limited right needed to use the service.
5. Acceptable use and prohibited conduct
Use the service and results only for lawful product-image work. You must not:
- Create or distribute material that violates law or another person’s intellectual-property, privacy, or publicity rights, or promotes counterfeiting, impersonation, fraud, deceptive advertising, or illegal goods or services.
- Use the service for child sexual exploitation, non-consensual sexual content, hate or harassment, violent extremism, harm to others, or uploading sensitive personal or biometric information without a lawful basis.
- Present AI-altered product features, performance, certifications, prices, or reviews as fact, or knowingly publish logos, watermarks, or main-image edits prohibited by a sales channel.
- Bypass authentication, authorization, rate limits, billing, or the credit ledger; probe or exploit vulnerabilities; transmit malware; overload the service; or use unauthorized automation, scraping, or reverse engineering, except where applicable law expressly permits it.
Shotmerce may reject input, limit features, or suspend an account as reasonably needed to investigate a violation, fraud, a security risk, or a legal request. Unless law or security prevents it, we will try to explain a material action and how to contact us about it.
6. App license, stores, and external services
- Shotmerce grants you a limited, personal, non-exclusive, non-transferable license to use the app on devices you own or control as permitted by store usage rules. The Apple Standard Licensed Application End User License Agreement applies to the iOS app license in addition to these Terms, and use of Google Play is subject to the Google Play Terms of Service.
- These Terms are between you and KCREW, the provider of Shotmerce, not Apple or Google. KCREW is responsible for the app, maintenance and support, and app-related claims to the extent required by law. Apple and Google are not responsible for providing or supporting the Shotmerce service.
- Apple is a third-party beneficiary of the terms applicable to the iOS app and may enforce those terms. You represent that you are not located in an area, or listed as a person, barred from using the app by applicable export-control or sanctions law, and you must follow relevant third-party service terms.
- OpenAI, RevenueCat, Apple, Google, and hosting/network providers can affect Shotmerce functionality. Shotmerce reasonably selects and manages these providers but cannot control their outages or policy changes.
7. Suspension, ending use, and account deletion
- You may stop using the service at any time. In the app, reauthenticate with the same linked Google or Apple account and enter DELETE, or use the account-deletion web page for an eligible legacy password account, to request permanent deletion.
- A deletion request immediately blocks new work and sessions and removes recoverable image files. Remaining account data is queued for deletion right away and retried during scheduled maintenance if needed. - Account deletion cannot be undone and removes unused credits, generation history, and recoverable results. Unused credits are not transferred or cashed out merely because an account is deleted, without limiting cancellation or refund rights required by law. De-identified transaction records may remain as needed for accounting, refunds, disputes, fraud prevention, or legal obligations.
- Shotmerce may limit, suspend, or terminate an account or feature for a material Terms violation, fraud, payment reversal, security risk, legal requirement, or service protection. Where practical, we will give advance or prompt later notice and a way to contact us; applicable law and store refund rules control the treatment of credits.
8. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service and AI results are provided “as is” and “as available.” Shotmerce does not warrant uninterrupted or error-free operation, accuracy, fitness for a particular purpose or sales channel, or non-infringement. This does not limit non-waivable consumer rights or an express commitment Shotmerce makes to you.
To the maximum extent permitted by law, Shotmerce is not liable for indirect, special, incidental, or consequential loss, or lost profit, revenue, data, or business opportunity arising from use of the service. Shotmerce’s aggregate liability for all claims will not exceed the amount you actually paid for Shotmerce credits during the 12 months before the event giving rise to the claim. These limits do not apply to willful misconduct or gross negligence, death or personal injury, fraud, or liability that law does not allow us to limit.
9. Changes and governing law
- We may revise these Terms when the service, store requirements, or law changes. Material changes will update the effective date and, where appropriate, be announced in the app or by account email. We will request consent where law requires it; otherwise, continued use after the change takes effect is subject to the revised Terms.
- These Terms and the service are governed by the laws of the Republic of Korea, without displacing mandatory consumer protections or courts available where you live. If a dispute arises, you may first contact support so we can try to resolve it.
- If part of these Terms is unenforceable, the remaining provisions continue in effect. A delay in enforcing a provision is not a waiver of that right.
